            Jessop & Company’s attorneys bring a wide array of experience to every bankruptcy and reorganization representation.  Together, we have acted as counsel to businesses of all sizes and in many different industry segments.  We represent debtors-in-possession, bankruptcy trustees, creditors committees, liquidating agents, lenders, asset purchasers, creditors and a variety of other clients in reorganization and liquidation proceedings around the nation.  This breadth of experience allows Jessop & Company to understand the issues not just from a complex legal perspective but from a practical business oriented approach.  Further, we approach each engagement with a thorough understanding of the practical interests, strengths and weaknesses of each stakeholder.

 

            Among the many cases and transactions in which Jessop & Company has been involved are:

 

·       Counsel for Energy Fuels Exploration Company and Energy Fuels Limited, the largest uranium mining companies in the U.S., in connection with their Chapter 11 cases.  These cases were consolidated with the bankruptcy case of their owner, Oren L. Benton.  Debt ranged from $500 million to over $1 billion.

 

·       Counsel for KG Retail Stores, Inc., a men’s clothing retailer, in connection with its Chapter 11 case and emergency sale of 91 retail stores.

 

·       Counsel to the City and County of Denver in connection with Denver International Airport.  He has represented Denver in over fifteen major airline bankruptcies throughout the nation.  Mr. Jessop obtained over $3 million in the Western Pacific Airlines bankruptcy and was an active member of the creditors committee.  He is currently representing the City’s interests in the UAL bankruptcy in Chicago, Illinois, the Midway bankruptcy in Raleigh, North Carolina, the TWA bankruptcy in Wilmington, Delaware and the Kitty Hawk Air bankruptcy in Ft. Worth, Texas.

 

·       Counsel to the City and County of San Francisco in connection with the San Francisco International Airport.  Mr. Jessop was the designated member for San Francisco on the Official Unsecured Creditors Committee for the UAL bankruptcy for three years.  Jessop & Company continues to represent the City in various other bankruptcies across the country. 

 

·       Special Counsel to the City of Phoenix in connection with its airport system and all bankruptcy and insolvency matters including response planning and strategies.

 

·       Counsel for various municipal airports in connection with bankruptcy matters including the City of Chicago, City of Sacramento, Metropolitan Washington Airports Authority, Pitkin County, Colorado, Port of Portland, Port of San Diego, Port of Seattle and the City and County of San Francisco.

 

·       Chapter 11 bankruptcy counsel for Univance Telecommunications, Inc. and Univance Marketing Group, Inc., a small telecommunications company based in the Denver Metro area and operating in all 48 continental states.

 

·       Counsel to a variety of dot.com and telecom companies in connection with out of court settlements and workouts.

 

·       Counsel for MSHOW.com, Inc., an internet web conferencing company, in connection with its Chapter 11 case and reorganization.

 

·       Counsel for Western Integrated Networks, LLC d/b/a WinFirst, a telecommunications “overbuilder” based in Sacramento which was building a fiber optic network to deliver telephony, data and video in connection with its Chapter 11 case and reorganization.

 

·       Counsel to Polydyne International, Inc., in connection with its chapter 11 case.  Polydyne was a fraudulent investment company with over $20 million of German creditors.  Jessop & Company successfully investigated the assets of the company and the actions of the former principals despite confusing and incomplete business records.  The Firm also assisted German authorities in their investigations which resulted in the conviction and imprisonment of the former president.  Ultimately, the company was successfully reorganized with trade creditors receiving 100% payout plus interest and the investor creditors receiving 60% of a new company set up to own and develop the remaining real estate asset.

 

·       Counsel to Blue Bear, LLC, in connection with its chapter 11 case.  Blue Bear was another fraudulent investment company with over $18 million of investor creditors.  Jessop & Company successfully investigated the assets of the company and the actions of the former principals despite the state of its records.  Jessop & Company won the trust of the creditors and successfully confirmed a plan of reorganization for the company.  Litigation is still ongoing.

 

·       Counsel for Philips Credit Corporation, the leasing subsidiary of Philips N.V., in connection with equipment leases in numerous hotels around the country.

 


·       Counsel for the chapter 7 bankruptcy trustee of George N. Gillett, Jr.  Jessop & Company administered, investigated and liquidated a diverse portfolio of assets (with aggregate values in excess of $500 million) including interests in a bank, an equipment leasing company, television stations, a radio station, a fixed base operation in Vail, a magazine, the largest cattle ranch in North America and a horse ranch in California.

           

·       Counsel for Sony Electronics, Inc., in connection with the enforcement of equipment leases in the Denver area.

 

·       Counsel to the chapter 7 trustee of The Stuart James Company, Inc., the largest U.S. penny stock broker at the time of its demise in 1990.  This case started one year after shut-down with no known assets available to creditors.  Through detailed investigation and intensive litigation, the Firm recovered over $3.1 million for the benefit of creditors resulting in a dividend of over 55% to unsecured creditors.

 

·       General Counsel for Tecmar Technologies International, Inc., a high tech data storage company traded on the Oslo Stock Exchange.  This representation arose out of the successful representation of its predecessor, Rexon Inc., in its Chapter 11 case.  During this representation, Mr. Jessop gained an intimate knowledge of the day-to-day operations and issues of a large corporation with multiple subsidiaries and directed the liquidation of companies in England, Germany and Singapore.  Ultimately, Mr. Jessop directed the sale of Tecmar and its remaining subsidiaries pursuant to an emergency sale in their own Chapter 11 cases in Delaware.

 

·       Counsel for FNRS Financial Corporation, a mortgage servicing company, in its Chapter 11 case.

 

·       Counsel to various financial institutions in connection with bankruptcy matters including Farmers State Bank of Calhan, Key Bank of Wyoming, Montegra Capital Resources, Inc., National Westminster Bank USA and NationsBank.

DOUGLAS W. JESSOP

 

            Mr. Jessop is the founder and head of Jessop & Company.  He represents numerous business entities in a broad range of transactions, restructurings, bankruptcies and bankruptcy litigation.  Because of his diverse experiences, Mr. Jessop often brings a fresh, creative approach to difficult, complex situations.  His style blends diplomacy and practicality with incisive legal knowledge to reach the desired goal.

 

            Mr. Jessop is a frequent lecturer and writer on bankruptcy law issues.  He is an author of the Bankruptcy Chapter and Annual Updates for the Krendl Colorado Methods of Practice for over ten years.  He practiced commercial law, corporate and municipal finance and bankruptcy at large Denver firms prior to forming the firm in 1991.


 

Mr. Jessop graduated from the University of Colorado in 1973 with a Bachelor of Arts degree and in 1975 with a Master of Arts degree.  He received his Juris Doctorate degree, magna cum laude, from Boston College Law School in 1983.  While in law school, Mr. Jessop was both the Solicitations Editor and an Articles Editor for Boston College Law Review, inducted as a member of the Order of the Coif (a legal honor society) and Alpha Sigma Nu (a Jesuit honor society) and graduated second in his class.  After graduation, Mr. Jessop was an attorney at the Denver law firms of Sherman & Howard where his practice emphasized municipal finance and Davis, Graham and Stubbs where his practice emphasized corporate bankruptcy.  In 1987, Mr. Jessop was an assistant professor of law at South Texas College of Law in Houston, Texas.  He is a member of the American Bar Association (Business Law Section), the American Bankruptcy Institute, the Turnaround Management Association, the Colorado Bar Association and the Denver Bar Association.  He has been on the board of advisors for the annual ABI Rocky Mountain bankruptcy conference for the past eight years.

 

 

ALICE A. WHITE

 

As a former in-house corporate attorney for a Fortune 500 company, Ms. White brings to her practice an intimate understanding of the needs of corporate clients.  Ms. White’s practice focuses on insolvency and corporate transactions.  She was admitted to the Pennsylvania bar in 1984 and the Colorado bar in 1985.  She received her A.B. degree in 1974 with General Honors from Rutgers - The State University, Douglass College, became a member of Phi Beta Kappa in 1974, and received her J.D. degree in 1983 with Honors from the National Law Center at The George Washington University.  Prior to Jessop & Company, she was in-house counsel for AMAX Inc., Golden, Colorado.  She is a co-author of “Removal of an Operator From a Mining Joint Venture,” which was published in the proceedings of the Thirty-Seventh Annual Rocky Mountain Mineral Law Institute, 1991.  Her professional affiliations include membership in the American Bankruptcy Institute and the Colorado Women’s Bar Association.  Ms. White is very active with community service organizations, and served as a member of the Jefferson County Cultural Council (SCFD) for six years, as well as serving with other organizations.  She is currently a board member of the Colorado Mountain Club and the Colorado Mountain Club Foundation.  She joined Jessop & Company in 1997.

 

 

J. BRIAN FLETCHER

 

            Mr. Fletcher joined Jessop & Company as an Associate in 2002 and practices in business and bankruptcy law.  Mr. Fletcher received his Bachelor of Arts degree in Political Science from the University of Northern Colorado in 1990.  He received his Juris Doctor degree in 1997 from Willamette University College of Law in Salem, Oregon, where he was elected to the Order of the Barristers for his moot court participation and membership.  Prior to joining Jessop & Company, Mr. Fletcher worked at Sherman & Howard, LLC from 2000 to 2002 where he assisted with several large telecommunication mergers.  He is a member of the American Bar Association, Colorado Bar Association, Business and ADR Sections and Denver Bar Association.  He was Secretary of the ADR Forum Committee during 2001.

 

 

MEGAN M. HANDLEY

 

Ms. Handley joined Jessop & Company as an Associate in 2005.  She was born in Layton, Utah, on October 15, 1979 and admitted to the Colorado bar in 2005.  She received her Bachelor of Arts degree from the University of Pittsburgh in 2002 and her Juris Doctor degree in 2005 from the University of Denver College of Law.  While attending law school, Ms. Handley clerked for Chief Judge John P. Leopold, Judge William B. Sylvester, both of the 18th Judicial District of the State of Colorado, and Chief Judge Sidney B. Brooks of the United States Bankruptcy Court for the District of Colorado.  Ms. Handley is currently a member of the American Bankruptcy Institute, Colorado Bar Association and the Denver Bar Association. 

 

 

ANNIE-CAITLIN HOWE

 

            Ms. Howe joined Jessop & Company as an Associate in 2006.  Born and raised in Bingham Canyon, Utah, Ms. Howe was admitted to the Colorado bar in 2006.  She received her Bachelor of Arts degree in economics from the University of California, Berkeley in 2001 and her Juris Doctor degree from the University of Colorado School of Law in 2006.  While attending law school, Ms. Howe was a founding member of the Construction and Real Estate Law Association, clerked for Jessop & Company and served as a research assistant for Professor Paul Campos.  Ms. Howe is currently a member of the American Bankruptcy Institute and the Colorado Bar Association.

 

K. LANE CUTLER

 

            Ms. Cutler joined Jessop & Company as an Associate in 2006 and practices bankruptcy and general litigation.  She received her Bachelor of Arts degree in Business Administration and Political Science, magna cum laude, from Queens University of Charlotte (North Carolina) in 1990.  She received her Juris Doctor degree, with honors, in 1993 from the University of North Carolina School of Law, Chapel Hill.  During law school, Ms. Cutler served as a staff member of the North Carolina Law Review and a member of the National Moot Court team.  After law school, she served as a law clerk to the Honorable Frank W. Bullock, Jr., United States District Court for the Middle District of North Carolina.  She then worked seven years in private practice, emphasizing business bankruptcy and business litigation.  After moving to Colorado in 2000, Ms. Cutler served as staff attorney and law clerk for the United States Bankruptcy Appellate Panel of the Tenth Circuit and law clerk to the Honorable Elizabeth E. Brown, United States Bankruptcy Court for the District of Colorado.
